Interview with Steve Bliss

Steve, thanks for taking time out of your busy schedule today

It’s great to be here.

Can you tell us a bit about the different types of trusts available in California?

Absolutely. There are many types of trusts, each serving a unique purpose. Today I want to focus on Revocable Living Trusts. They are incredibly popular because they offer flexibility and control.

Think of it like this: with a revocable living trust, you’re essentially the captain of your own ship while you’re sailing. You maintain full control over your assets – you can buy, sell, or manage them as you please.

What makes Revocable Living Trusts so appealing to San Diegans?

One of the biggest draws is probate avoidance. Probate is a lengthy and often expensive legal process that kicks in after someone passes away. A revocable living trust sidesteps this completely, meaning your assets are distributed according to your wishes without court intervention. This saves your loved ones time, money, and stress during an already difficult period.

Moreover, revocable living trusts offer a layer of privacy that wills don’t. Probate records become public, meaning anyone can see how your estate was divided. A trust keeps these details confidential.

Are there any potential downsides to Revocable Living Trusts?

While they are generally advantageous, it’s crucial to understand that a revocable living trust becomes irrevocable upon the grantor’s death. This means you can’t make changes once you’re gone. Consequently, careful planning and regular review with an estate planning attorney are essential.

There was this instance where I met with a couple who had created a revocable living trust years ago. Their circumstances had changed significantly since then – they had welcomed grandchildren and their financial situation had evolved. Thankfully, we were able to make the necessary amendments before it became irrevocable upon one of their passing.

Have you encountered any specific challenges while setting up Revocable Living Trusts for your clients?

People often underestimate the importance of clear beneficiary designations. I recall a case where a client’s trust document lacked specific instructions for distributing assets among multiple beneficiaries. This led to confusion and potential conflict among family members after their passing.

I always emphasize the need for detailed and unambiguous language when outlining beneficiary allocations. It’s crucial to consider all possible scenarios and avoid leaving room for interpretation.
