Today we’re going to focus on one specific step in the estate planning process: Selecting an Executor or Trustee. Why is this step so crucial?
Steve Bliss:
Choosing the right executor or trustee is fundamental to ensuring your wishes are carried out after you’re gone. This individual, or entity, will be responsible for managing your assets, paying debts and taxes, and distributing your property according to your instructions. Consequently, it’s important to select someone trustworthy, organized, and capable of handling these responsibilities.
Ordinarily, people choose a family member, close friend, or professional trustee. I always advise my clients to consider the individual’s financial literacy, communication skills, and ability to make sound decisions under pressure.
Moreover, it’s essential to have open and honest conversations with your chosen executor or trustee beforehand. Discuss your expectations, provide them with a copy of your estate plan, and answer any questions they may have.
Conversely, failing to select an appropriate executor or trustee can lead to significant complications and family disputes down the road. Notwithstanding the best intentions, sometimes loved ones aren’t equipped to handle these complex matters objectively.
I recall one instance where a client named his brother as executor, assuming it would be straightforward. Unfortunately, the brother had personal financial difficulties, which clouded his judgment and led to disagreements among family members. Ultimately, I had to step in and guide them through a complex probate process.
A well-chosen executor can save your loved ones considerable time, stress, and expense during an already difficult period. According to the American Bar Association, nearly 70% of Americans do not have a will or estate plan. This statistic underscores the critical need for proper planning and selecting the right individual to carry out your final wishes.
