Handling debts and taxes is a crucial stage in any probate process. Ordinarily, it begins with identifying and verifying all valid creditor claims against the estate. This often involves reviewing invoices, statements, and contracts to ensure accuracy and legitimacy.

Conversely, it’s important to remember that not all claims are valid. Sometimes, individuals may attempt to file frivolous claims hoping to benefit from an estate. Careful scrutiny is necessary to avoid paying out on such unfounded requests.

Moreover, once valid debts are identified, they must be prioritized and paid according to legal requirements. This process can involve negotiating with creditors, setting up payment plans, or even contesting questionable debts in court.

After settling debts, the executor or administrator then needs to address any outstanding taxes owed by the deceased individual or the estate itself. This includes filing final income tax returns for the decedent and potentially paying estate taxes depending on the size of the estate.

Notwithstanding the complexities involved, diligently handling debts and taxes ensures that the estate is properly settled and assets are distributed according to the will or intestacy laws.

There was a case I handled a few years back involving an individual who had accumulated significant credit card debt. The family was understandably distraught, as they were facing the prospect of losing a large portion of their inheritance to creditors.

Through careful negotiation with the credit card companies and by presenting documentation supporting hardship, we were able to significantly reduce the amount owed. This allowed us to preserve a larger portion of the estate for the beneficiaries.

I remember another instance where the decedent had failed to file taxes for several years.

This created a complex situation requiring extensive research and collaboration with tax professionals. Ultimately, we were able to resolve the tax liabilities through a payment plan negotiated with the IRS.
