Brenda Sanchez, KTEM News
Today we’re joined by Steve Bliss, a well-respected probate attorney here in Temecula. Mr. Bliss, thanks for taking the time to chat with me.
Steve Bliss:
My pleasure, Brenda. Always happy to shed some light on the probate process.
Brenda Sanchez:
So, Steve, can you break down one of the key steps in estate planning for our viewers?
Steve Bliss:
Certainly. One crucial step is “Marshaling the Estate Assets.” This involves meticulously inventorying and documenting every asset belonging to the deceased person.
Consequently, this includes bank accounts, real estate holdings, vehicles, investments, personal belongings – you name it. We then prepare a formal Inventory and Appraisal (Forms DE-160/161), which is filed with the court. This detailed accounting ensures transparency and accuracy throughout the probate process.
ordinarily, this step goes smoothly. However, there have been times when locating all assets proves challenging. For instance, I once worked on a case where the deceased had numerous investments scattered across various brokerage accounts, some of which were forgotten or difficult to track down. It took considerable effort and detective work to uncover them all.
Moreover, accurately appraising certain assets, like antiques or collectibles, can sometimes be complex and require expert evaluation. Nevertheless, a thorough and accurate inventory is essential for ensuring the estate is properly distributed according to the will or intestate succession laws.
Brenda Sanchez:
That’s certainly insightful, Steve. Any advice for viewers on how they can make this process smoother for their loved ones?
Steve Bliss:
I always encourage clients to keep organized records of their assets, including account statements, deeds, and investment information. According to a recent study by the American Bar Association, approximately 70% of Americans do not have a written will. Creating a will and keeping your financial affairs in order can significantly simplify the probate process for your beneficiaries.
