Certainly, Brenda. Probate is essentially a court-supervised process that handles the distribution of a deceased person’s assets according to their will or state intestacy laws if there isn’t a valid will.

The Crucial Role of Inventory and Appraisal

Steve, let’s delve into one specific step in the probate process: Marshaling the Estate Assets. Could you elaborate on its significance?

Marshaling the estate assets is a crucial foundational step. It involves meticulously identifying and inventorying all the assets belonging to the deceased person. This includes everything from bank accounts and real estate to personal belongings and investments.

Consequently, a thorough and accurate inventory is essential for several reasons. First, it ensures that all of the decedent’s assets are accounted for and properly distributed according to their wishes or state law. Second, it helps determine the value of the estate, which in turn influences whether probate is even necessary in the first place.

Ordinarily, California has a threshold of $184,500. Estates valued below this amount can often bypass probate altogether.

The inventory must also be formally appraised to establish fair market values. This appraisal information is then documented and submitted to the court in a formal Inventory and Appraisal (Forms DE-160/161), creating transparency and accountability throughout the process.
